K-LOULUX App Terms of Use
Article 1 (Scope)
- These terms set the conditions for using the smartphone app "K-LOULUX" ("the app") provided by K-LOULUX (sole proprietorship; operator's name is disclosed without delay on request to info@k-loulux.com) ("we", "the studio"). Purchases on the website are governed by the website's terms of service.
- Users use the app having agreed to these terms. Registering an account constitutes agreement, and we record the date and time of agreement and the terms version.
- Personal information is handled under the separate App Privacy Policy.
Article 2 (Accounts)
- Users must register with accurate information (email address, display name) and are responsible for keeping their email address and password safe.
- Accounts may not be lent or transferred. If you notice unauthorised use, contact info@k-loulux.com immediately.
- The minimum age is 16. Minors need a parent's or guardian's consent.
- Users can delete their account at any time in the app (Profile > Delete account). It is not possible while an order is approved, in production or ready for handover. Records that must be kept by law, such as transaction records (orders, quotes, payments), are kept in anonymised form for a limited period (about 7 years) as described in the Privacy Policy.
Article 3 (Services)
The app provides (1) requesting, quoting, paying for and following made-to-order items, (2) chat with the studio (including sending photos), (3) a community where users share creations and photos of themselves wearing them and can follow other users and the studio, and (4) push notifications if you wish (new messages, quote and order progress, payments, comments, new followers and new posts from studios you follow; you can stop them at any time on the profile screen or in your device settings). Categories: kimono, tailoring, African wear, upcycling (alterations and remaking) and small items.
Article 4 (How made-to-order works)
- Request: the user requests an order in the app. Please enter reference photos, measurements and other information as accurately as possible. We are not responsible for poor fit caused by incorrect measurements, but we will help find a solution.
- Quote: the studio presents a quote itemised into labour, fabric and other costs. All prices are in Japanese yen and include 10% consumption tax.
- Approval and deposit: when the user approves a quote, the order is confirmed. On approval, a deposit of 50% of the quote total (tax included) is paid; this may be changed per quote and, if so, is shown in the quote.
- Fabric: fabric is shown as a line in the quote and is included in the quote total (tax included).
- Production: progress can be followed in the app. Discuss changes of specification in chat; changes may alter the cost and timing.
- Balance and delivery: the balance is paid after the item is finished and before handover (shipping). The balance is due within 7 days of our notice that the item is finished. Delivery is by post within Japan; shipping is charged at cost and stated in the quote; please contact us about overseas shipping or pick-up.
- Timing: the lead time is stated in the quote and is indicative only; it may vary with the availability of materials and production.
- If the user declines a quote, the order returns to the "requested" state and the user can receive a new quote.
Article 5 (Prices and payment)
- Payments in the app are made in Japanese yen through our payment provider, Stripe, Inc. Card details are handled by Stripe; they do not reach our servers and we do not hold them. Payment is by credit card (Visa, Mastercard, American Express, JCB and other brands supported by Stripe).
- For sale conditions (seller, payment timing, delivery timing, etc.), see the Notice under the Act on Specified Commercial Transactions.
- Refunds are normally made manually by the studio from the payment provider's dashboard to the original payment method. If a payment is completed for an order that has already been cancelled, it is refunded in full automatically. An order that has been paid cannot be cancelled until the refund procedure is complete. If a card dispute is filed, we respond according to the payment provider's procedure.
- What is purchased in the app are real goods and services (making custom clothing and small items), not in-app purchases of digital content.
Article 6 (Cancellation, refunds and defects)
Because made-to-order items are made individually to the customer's measurements and specifications, the following rules apply, which are the same as in the website's refund policy.
- Before quote approval: if the order is "requested" or "quoted", the user can cancel it in the app free of charge.
- After approval, before production starts: the order can be cancelled before production begins. Materials already purchased and work already done remain payable by the customer. The deposit is refunded minus these costs. "Production started" means the app status has changed to "in production".
- After production has started: made-to-order items cannot be returned or refunded for reasons on the customer's side (purchased materials and work done remain payable).
- Defects or non-conformity: if the item does not match what was agreed or has a sewing defect, contact us in chat or at info@k-loulux.com within 7 days of receiving it (a photo helps). We will adjust or remake the item. We pay shipping.
- If we cancel for our own reasons, we refund what you have paid in full.
- Refund method and timing: to the original payment method. Refunds are processed within about 10 business days after the procedure is complete.
- The 14-day return rule for ready-to-wear and accessories sold on the website does not apply to made-to-order items.
Article 7 (Community and posting rules)
- Users are responsible for the text, images and comments they post ("posts"). Copyright stays with the user, but the user grants us the right to use posts as needed to display them in the app and in the studio's official presentations. Use on official social media only with the user's separate consent.
- The following are prohibited:
- anything illegal or contrary to public order, or encouraging illegal acts
- anything infringing others' rights (copyright, portrait rights, privacy, reputation, etc.); photos showing other people only with their consent
- discrimination, hate, defamation, harassment, threats, violent, sexual or obscene content
- false information, impersonation, spam, solicitation or commercial promotion without our permission
- content harmful to minors
- interfering with the operation of the app, unauthorised access or reverse engineering
- Reports: users can report other users' posts, comments or accounts in the app (reasons: spam, inappropriate, harassment, other). We review reports and respond appropriately, aiming to do so within 2 business days.
- Following: users can follow other users whose profile they can view, and the studio. Following is one-way and needs no approval. The follow relationship (who follows whom) can be seen only by the two people concerned and the studio; follower and following counts are shown to users who can view that profile. You may be notified of a new follower. Users who follow the studio may be notified of its new posts. You can unfollow at any time. Repeatedly following for the purpose of harassment is prohibited.
- Blocking: users can block another user and hide their posts and comments. Blocking automatically removes follows between you in both directions and prevents following each other. You can unblock in settings, but unblocking does not restore follows. Blocking applies only to community features, not to chat with the studio.
- Removal and restriction: we may hide or delete posts that violate or may violate these terms without notice, and may restrict features or suspend or delete accounts of users who repeatedly violate them.
- We have no obligation to review posts in advance.
Article 8 (Prohibited acts)
In addition to the preceding article: nuisance to other users or to us, obtaining or trading accounts improperly, impersonating the studio, using chat or ordering for purposes other than intended, and any other act we judge inappropriate.
Article 9 (Intellectual property)
- Rights in the app and its contents (logo, design, text, images, etc.) belong to us or the rightful owners. Reproduction without permission is prohibited.
- Users guarantee that images and designs supplied as references do not infringe third-party rights.
- Rights in the designs and patterns of works we make: belong to the studio (except designs and materials supplied by the customer).
Article 10 (Changes, suspension and end of the app)
We may change, suspend or end all or part of the app without notice due to maintenance, failure, force majeure or other circumstances. We will deal in good faith with the performance of any orders in progress.
Article 11 (Disclaimer)
- The app is provided as is; we do not guarantee fitness for a particular purpose, uninterrupted service or complete accuracy.
- Except where we act intentionally or with gross negligence, we are not liable for damage arising from use of the app. Even where we are liable, our liability is limited to the amount the user paid us for the order concerned. This does not apply where the Consumer Contract Act or other laws do not allow exclusion.
- Disputes between users are to be resolved between them; we are not liable.
- Colours may look different from the real item depending on your screen and lighting. African fabric patterns and colours vary slightly. As items are handmade, slight individual differences may occur.
Article 12 (Suspension and termination)
If a user violates these terms, or when we consider it necessary, we may suspend use of the app or delete the account without notice. Even then, settlement for orders already placed is handled under Article 6.
Article 13 (Changes to these terms)
We may change these terms when necessary. The new terms take effect when posted on this page or in the app. Important changes will be announced in the app.
Article 14 (Governing law and jurisdiction)
- These terms are governed by Japanese law.
- If a dispute arises, please contact us first so that we can seek an amicable solution. If it is not resolved, the Tokyo District Court has exclusive first-instance jurisdiction (to the extent consistent with mandatory consumer-protection rules).
